Terms of Purchase and Sale

Seller

1. General terms

1.1. These online store terms (the Terms) are a legally binding document between the Buyer and the Seller that defines the rights and obligations of the parties.

1.2. The Seller may change, correct, or supplement these Terms at any time. Changes to the Terms will be communicated to the Buyer on the online store page.

2. Formation of the sales contract

2.1. The sales contract between the Buyer and the Seller is deemed concluded at the moment the Buyer, having first reviewed these Terms, places and submits a product order in the online store.

3. Seller's rights

3.1. In significant circumstances, the Seller may temporarily or completely suspend the operation of the online store without prior notice to the Buyer.

3.2. If the Buyer attempts to harm the operation, stability, or security of the online store or violates their obligations, the Seller has the right to restrict or suspend access to the online store without warning.

4. Seller's obligations

4.1. The Seller undertakes to ensure the possibility to use the services of the online store in accordance with these Terms.

4.2. The Seller undertakes to deliver the products purchased by the Buyer in the manner chosen by the Buyer and under the conditions set out in these Terms.

4.3. If, due to unforeseen circumstances, the Seller cannot deliver the products ordered in the online store, the Seller has the right to terminate the sales contract by informing the Buyer in advance. The Seller may offer a similar product. If the Buyer refuses, the Seller undertakes to refund the paid money within 3 business days.

4.4. If the Buyer exercises the rights referred to in clause 5.2 of the Terms, the Seller undertakes to refund the Buyer the money paid within 5 (five) business days from the day the returned product is received.

4.5. The Seller may withhold the refund until the products are returned to the Seller or the Buyer provides proof that the products have been sent to the Seller, whichever occurs first.

5. Buyer's rights

5.1. The Buyer has the right to purchase products from the online store in accordance with these Terms.

5.2. The Buyer has the right to withdraw from the sales contract concluded in the online store by notifying the Seller in writing no later than 14 (fourteen) calendar days from the day of receipt of the product.

5.3. The rights referred to in clause 5.2 may be exercised only if the product is not damaged, its appearance has not changed substantially, and it has not been used.

6. Buyer's obligations

6.1. The Buyer is obliged to pay for the purchased products and to receive them in accordance with these Terms.

6.2. If the Buyer refuses to accept the products without a valid reason, the Buyer shall cover, at the Seller's request, the costs of returning the products.

6.3. When receiving the products, the Buyer must check the condition of the shipment and the products together with the Seller or the courier.

6.4. By using the online store, the Buyer confirms that they accept these Terms of Purchase and Sale and undertake to comply with them.

7. Product prices

7.1. Product prices in the online store are indicated in euros and include value added tax (VAT). After confirming the order, the delivery cost is added to the total amount if applicable.

8. Ordering and payment

8.1. When visiting the online store, the Buyer selects the desired products and adds them to the cart. After filling the cart, the Buyer enters the personal data necessary to complete the order: first name, last name, delivery address, phone number, and any additional information that may be important for receiving the products. The Buyer confirms that they have reviewed these Terms and confirms the order.

8.2. Payments are processed securely by Stripe (Stripe Payments Europe, Ltd., Ireland). Accepted methods: Visa and Mastercard credit and debit cards, Apple Pay, and Google Pay. All payments are made in euros (EUR). The Seller does not request or store full card details. They are handled directly by Stripe in line with PCI DSS standards, and every payment is encrypted with TLS.

9. Delivery of products

9.1. When ordering products, the Buyer must provide an accurate delivery address for the product.

9.2. The Buyer must receive the product personally. If the Buyer cannot receive the product personally but the product is delivered to the address provided by the Buyer, the Buyer has no right to make claims on the grounds that the product was handed over to a third person.

9.3. The Seller delivers products within the time frames indicated in the product descriptions. Personalized bowls are made within 3 days. Delivery across Europe to the customer's door by DPD or DHL courier takes 3 to 7 business days. The shipping cost is EUR 7.99. The total time from order to delivery is usually about 6 to 10 business days. For destinations outside Europe, please write to info@mambo.lt.

9.4. The characteristics of all products sold are indicated in each product description. The Seller is not responsible if the color, shape, or other parameters of the products in the online store do not match the actual size, shape, and color of the products due to the features of the Buyer's display.

9.5. If the Buyer withdraws from the sales contract, all amounts paid by the Buyer, including delivery costs paid by the Buyer, will be refunded.

10. Return of products

10.1. Products of satisfactory quality may be returned within 14 days from the day of receipt. Defects of products sold with quality issues will be remedied, defective products will be exchanged, or a refund will be issued in accordance with applicable law.

10.2. The following conditions apply to returns:

  • 10.2.1. The returned product must be in its original packaging and undamaged (this does not apply when returning a defective product).
  • 10.2.2. The product must not be damaged by the Buyer.
  • 10.2.3. The product must be unused and preserve its commercial appearance: intact labels, protective films not removed, etc. (this does not apply when returning a defective product).
  • 10.2.4. The returned product must be in the same configuration as received by the Buyer (this does not apply when returning a defective product).
  • 10.2.5. The Seller has the right to refuse to accept products returned by the Buyer if the return conditions are not met.
  • 10.2.6. Returns must be made in the manner specified by the Seller within 14 (fourteen) days from the day of receipt of the products (this does not apply when returning a defective product, in which case returns are made within the legal warranty period).

10.3. The return and exchange of properly functioning products is carried out in accordance with applicable consumer protection law and EU regulations.

10.4. Money paid for products received by the Buyer but subsequently returned will be refunded to the Buyer's account no later than 5 (five) days after the product is returned to the Seller, unless the Seller and the Buyer agree otherwise.

11. Personal data protection

11.1. The Buyer's personal data are processed in accordance with the Privacy Policy. Only the data necessary to fulfill the order are processed (first name, last name, email, phone, delivery address). If you have concerns or wish to lodge a complaint regarding the processing of personal data, you may contact the State Data Protection Inspectorate of Lithuania ( vdai.lrv.lt, the Seller's lead supervisory authority) or your local EU data protection authority.

12. Final provisions

12.1. These Terms are drawn up under the law of the Republic of Lithuania, taking into account applicable EU consumer directives.

12.2. These Terms and the relationships between the parties based on them are governed by and interpreted in accordance with the laws of the Republic of Lithuania.

12.3. All disputes related to these Terms shall be resolved by negotiation. If an agreement cannot be reached, disputes shall be resolved in accordance with the procedure established by law. A consumer who believes their rights have been violated may use the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

12.4. The parties are released from the fulfillment of obligations provided in these Terms if their fulfillment cannot be ensured due to unforeseen circumstances beyond the control of the parties (force majeure).
